Fotos4ads.com posts images and information provided to us by sellers who want to display images of what they are selling online. Sellers advertise their items and refer potential buyers to their image page on Fotos4ads.com. These policies apply to both sellers and potential buyers who access our website to view any images posted.

No Involvement in Transactions

1. While buyers may contact sellers after they review the seller's image page, Fotos4ads.com is not involved with any transaction between buyers and sellers and therefore does not represent or warrant that any transaction will be completed or, if completed, that it will be completed successfully.
   
2. Fotos4ads.com does not screen or control individuals who may buy or sell and therefore we have no control over the quality, safety or legality of the items advertised, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items.
   
3. Sellers and buyers are solely responsible for all aspects of any transaction in which they participate, including, without limitation, all applicable taxes and all costs.
   
4. Sellers and buyers are solely responsible for protecting themselves and resolving any disputes that may arise between them, regardless of the fact that images may have been posted on our site. Fotos4ads.com does not mediate disputes or assume responsibility for any outcome.
   
   

Prohibited Listings

We want our users to have a safe experience. Fotos4ads.com reserves the right to review all images and image descriptions submitted to us to confirm adherence to these Guidelines and other terms and conditions applicable to access and use of our website. By using Fotos4ads.com, you agree that you will not submit images or image descriptions for the purpose of posting, advertising or selling the following items or services under any circumstances:

1.  "Adult oriented" products or services or any item or service that is obscene or otherwise objectionable in our sole discretion.
   
   
2. Firearms, ammunition or accessories, including, without limitation, scopes and silencers.
   
   
3. Weapons such as switchblade knives, martial arts weapons or other concealed weapons
   
   
4. Explosive devices (or equipment to construct one) or material, including, without limitation, fireworks or other hazardous materials or chemicals.
   
   
5. Illegal drugs, drug paraphernalia (including items to grow, manufacture, or distribute drugs), prescription drugs and medical or other prescription devices.
   
   
6. Cigarettes (and other tobacco products) and alcohol.
   
   
7.  Items, goods or services that violate any international export law or regulation, including any items subject to the terms of any international embargo.
   
   
8. Items that infringe upon the rights of a third party, including items that violate copyrights, trademarks, publicity or privacy rights of third parties
   
   
9. Stolen or counterfeit goods.
   
   
10. Lockpicking materials and devices.
    
    
11. Hate material, including without limitation, any material that promotes, glorifies, or is directly associated with groups or individuals known principally for hate or hate speech or violent positions or acts. Items associated with groups or individuals known principally for their hateful or violent positions are prohibited.
    
    
12. Any animal, live or otherwise, the sale of which is prohibited by endangered species laws, as well as any items made from or including any parts of an animal protected by law or regulation. Fotos4ads.com welcomes images of domesticated pets that are being advertised by our clients for sale or adoption.
    
    
13. Any item that has been the subject of a product recall by a government agency or product manufacturer.
    
    
14. Any item used for hacking, intercepting, jamming, descrambling or otherwise obtaining unauthorized access to wire, electronic, cable or other types of communications and transmissions.
    
    
15. Human parts, remains and bodily fluids.
    
    
16. Government-issued identification documents or IDs, police badges or insignia, and any other law enforcement items (e.g., badges, uniforms, flashing lights/sirens, etc.).
    
    
17. Stocks and securities.
    
    
18. Images constituting solicitations to commit criminal activity.
    
    
19. Gambling items, including, without limitation, lottery tickets, sweepstakes, pyramid schemes, grab bags, raffles and slot machines.
    
    
20. Individual contracts, services, and any item that is non-transferable.
    
    
21. Event tickets sold for prices that are in violation of the laws or regulations of the event venue.
    
    
22. Non-packaged food items and other food or beverage items regulated by applicable legal regulations.
    
    
23. Any item harmful to minors, as determined in the sole discretion of Fotos4ads.com.
    
    
24. Any other item or service that violates any applicable local law or regulation or which Fotos4ads.com determines, in its sole discretion, is inappropriate for sale through the services provided by Fotos4ads.com.

Image Description Rules

Fotos4ads.com reserves the right to review all image descriptions submitted to us for editorial integrity, appropriateness and adherence to these Guidelines and other terms and conditions applicable to access and use of our website. In addition, Fotos4ads.com reserves the right to edit any image description to ensure compliance with these Guidelines.

1. Profanity: Should the title, description, URL or any other content of the image description you submit contain words that are offensive or profane, the description will be rejected and your image will be posted without the description. It will be your responsibility to provide us with a description that is acceptable for your posted image.
   
   
2. Irrelevance: If the content of an image description or the web site to which it links is contextually irrelevant to the category in which it is listed, then that ad will be rejected.
   
   
3. Sexual Content: If the content of an ad or the web site to which it links is pornographic or sexually offensive, the ad will be rejected.
   
   
4. Illegal: Any ad that promotes products and/or services deemed to be illegal or unethical will be rejected.

Sellers

If you request us to post images of items you wish to sell, you agree to the following:

1. You will not use this service for any fraudulent activity or purpose, including, without limitation, collecting payment from buyers and not providing the item or service purchased.

3. You will not transmit any image or image description to Fotos4ads.com that contains any viruses, trojan horses, worms, time bombs, cancelbots, or other computer programming routines that may damage, interfere with, surreptitiously intercept, or expropriate any system, data, or personal information.
   
   
4. You will not solicit Fotos4ads.com users to post ads on other websites.
   
   
5. You will not offer for sale or sell an item or service to any buyer in a jurisdiction where the item, service, or terms of the sale violate applicable laws or regulations. You also will not offer for sale any item or service that violates Fotos4ads.com policies as described above in "Prohibited Listings."
   
   
6. You will truthfully and accurately describe the item or services you are selling.
   
   
7. You will not offer any item for sale that you do not have the right to sell or that does not exist at the time you place an ad.

Payment

ALL SALES ARE FINAL. FOTOS4ADS.COM RESERVES THE UNRESTRICTED RIGHT TO REJECT, CANCEL OR REMOVE ANY IMAGE OR AD FOR ANY REASON AT ANY TIME. IF YOU PLACE AN ORDER AND SEND IMAGES OR IMAGE DESCRIPTIONS WHICH ARE PROHIBITED UNDER THESE IMAGE POSTING POLICIES, THE IMAGES WILL NOT BE POSTED AND ANY PAYMENT MADE WILL BE APPLIED TO SERVICE CHARGES AND THE ADMINISTRATIVE COSTS OF THE FOTOS4ADS.COM STAFF. YOU ARE ADVISED TO E-MAIL US AT INFO@FOTOS4ADS.COM IF YOU WISH TO DETERMINE IN ADVANCE WHETHER YOUR IMAGES OR IMAGE DESCRIPTIONS WOULD BE PROHIBITED BY FOTOS4ADS.COM POLICY.

Image Posting

The image posting duration begins the day your image is placed online on Fotos4ads.com and continues in effect for the duration stated on our website. You will not receive any refund if you request us to take your image off of our site prior to the expiration of its term. There are no partial reimbursements. Fotos4ads.com reserves the right to, at any time, revise the design, look and feel and layout of the Fotos4ads.com web site. If any such revision would result in the need to modify placement of your images, we may, in our discretion, do so.

Disclaimer of Warranties

1. YOU AGREE THAT ACCESS TO OUR SITE AND USE OF OUR SERVICES IS AT USER'S SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS"AND ON AN "AS AVAILABLE"BASIS. FOTOS4ADS.COM EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

FOTOS4ADS.COM MAKES NO WARRANTY THAT THE SERVICE WILL MEET USER'S REQUIREMENTS, THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES FOTOS4ADS.COM MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED FROM THE SERVICE.

USER WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE RESULTING FROM ANY TRANSACTION AND WILL INDEMNIFY, DEFEND AND HOLD FOTOS4ADS.COM HARMLESS FROM ANY COSTS OR LIABILITY .

We claim full rights to our company trademarks and branded trade names and will vigorously protect and defend our ownership of these trademarks and trade names in accordance with our common law and statutory rights and entitlements under federal and state copyright and trademark laws.
